Terrorism Financing: Court Restrains DSS from Arresting Emefiele

The Department of State Services (DSS) and the Economic and Financial Crimes Commission (EFCC) have been restrained from inviting and arresting the Governor of the Central Bank of Nigeria (CBN), Mr Godwin Emefiele.

It was reported earlier that the country’s secret police was making efforts to arrest Mr Emefiele over allegations bordering on terrorism financing.

The agency approached a federal high court in Abuja for an ex-parte order to detain the apex bank chief but its prayer was not granted by Justice John Terhemba Tsoho.

On Thursday, Justice M.A. Hassan of the Federal Capital Territory (FCT) High Court issued a restraining order on the DSS, EFCC, the Nigeria Police and the Attorney-General of the Federation (AGF).

Business Post reports that the suit was filed by a group known as Incorporated Trustees of Forum for Accountability and Good Leadership.

The court held that the “continuous harassment, intimidation, threats, restriction of free movement, abuse of the right of office, surreptitious moves to arrest, and humiliation of Mr Godwin Emefiele, the Governor of CBN over trumped up allegations of terrorism financing and fraudulent practise, etc. by the 2nd, 3rd, and 4th respondents and their offices is vindictive, unwarranted, abrasive, oppressive and same constitute a flagrant breach of his rights to personal liberty, the dignity of the human person, right to policy-making powers freedom of thought, conscience and religion and movement as respectively provided and enshrined under the Constitution of the Federal Republic of Nigerian, 1999 (as amended) and the African Charter on Human and Peoples’ Rights (rectification and enforcement) Act and therefore, unconstitutional and illegal.”
